Drug Testing Policy

Any Poarch Band of Creek Indians Licensee (Vendor, Principal, Employee or Applicant) may be required to submit to drug testing by the Poarch Band of Creek Indians Tribal Gaming Commission at any time with no prior notice. Any individual listed above may be selected for testing as follows:

  • A.   Pre-employment, re-licensing, or pre-services/product provision screening
  • B.   At random
  • C.   At the discretion of the Poarch Band of Creek Indians Tribal Gaming Commission
  • D.   For suspicion of being under the influence of drugs on the job or involvement in drug-related activity
  • E.   Due to involvement in an accident on the job or causing harm or injury to another person

The Poarch Band of Creek Indians Tribal Gaming Commission is not required to inform a Licensee as to the reason for their selection for drug testing.

Any Licensee who tests positive for use of illegal drugs shall have their license revoked and shall not be eligible for licensing by the Poarch Band of Creek Indians Tribal Gaming Commission for a period of six months.

Nothing in this policy shall be interpreted to create any right on the part of a Licensee to re-licensing after six months from forfeiture of license because of test results showing illegal drug use. Granting of a new license shall be completely at the discretion of the Poarch Band of Creek Indians Tribal Gaming Commission, which may take into account the Licensee's efforts at rehabilitation, past employment record, and all other relevant factors.

NOTE: An illegal substance is any substance prohibited by federal, state, or tribal law, or substances not prescribed to you by a United States physician.
